Waiver

Please read the waiver below and fill out the required fields found in the following form sections. All liability language from the waiver will apply to all household members listed below.

Safety Rules for Participants                          

 

The Aerial Adventure Park at Wild Acadia is a fun activity, but is also high risk and we require everyone to follow the safety rules and be courteous to other people on the course.

 

-        All participants must wear covered footwear, such as sneakers or other closed toed shoes (no crocs or similar style footwear)

-        All jewelry must be removed and long hair must be tied back

-        Piercings should be removed or taped over

-        No participants will be allowed on the course if they have consumed or appear to be under the influence of alcohol or other substances

-        Do not eat or chew gum while on the course

-        The course is not suitable for anyone who is or suspects they may be pregnant

-        The maximum limit in the ropes course for participants including clothing and gear is 275 lbs.

-        The maximum limit on the zip lines for participants including clothing and gear is 200 lbs

-        Please make staff aware of any medical condition which could affect you on the course. Examples include: epilepsy, hearing impairments and diabetes. Having these does not exclude you from doing the course; it just enables the staff to assist you correctly in the event of a problem.

 

SMART BELAYS MUST BE CLIPPED TO THE SAFETY CABLES AT ALL TIMES WHILE ON THE COURSE

 

-        If participants remove their harness for any reason, such as using the rest room, they must ask a Safety Instructor to check it before they go back on the course

-        You may have up to 2 people on a challenge at a time, with certain exceptions

-        There may be no more than 4 people on a platform at any time

-        In the event of thunder and/or lightning, the Safety Instructors will instruct participants to leave the course temporarily until the thunder and/or lightning passes. If harnessed, please head up to the harness room

 

PARTICIPANTS MUST FOLLOW THE TRANSFER PROCEDURE SHOWN IN GROUND SCHOOL

 

-        All participants will be required to attend an at least 10 minute ground school for the Aerial Adventure Park.  Anyone who, in the opinion of the Safety Instructor, is not deemed competent to perform the necessary safety precautions may not be allowed on the course. 

 

THE SAFETY INSTRUCTORS RESERVE THE RIGHT TO ASK ANYONE TO LEAVE WHO IS ENDANGERING THEMSELVES OR OTHERS WITHOUT REFUND.  Examples of endangering may include, but may not be limited to: unclipping themselves from the safety system, unclipping others from the safety system, failing to follow transfer procedure or deliberately trying to make other people fall off of the course. Safety Instructors reserve the right to enforce all safety measures to protect all participants.

 

Release and Waiver of Liability, Assumption of Risk and Agreement for Adults (18 years of age or older)

Every participant who takes part in the Aerial Adventure Park is expected to sign a copy of our “Release and Waiver of Liability, Assumption of Risk and Agreement” (the wording which appears below).

 

THIS IS AN IMPORTANT DOCUMENT: YOU MUST READ IT BEFORE SIGNING.

 

As the participant, I wish to participate in High and/or Low Ropes Course and zip line Activities (the “Activities”) organized and operated by Wild Acadia Fun Park (the “Company”).

  1. I certify that I am eighteen years of age or older. If not, please obtain the proper waiver for children under the age of eighteen.
  2. I acknowledge that I have been provided, reviewed, and executed the written Safety Rules attached to this document. In addition, I agree at all times to wear my harness with smart belays and helmet (the “safety system”) as instructed, and I acknowledge that at all times the safety system must remain connected to the safety cables provided. I understand that if I am viewed as endangering myself or others I may be asked to leave the course without a refund of admission.
  3. I acknowledge and accept that the activities may consist of a physically grueling aerial obstacle course and involve risks of serious bodily injury and that I am fit enough, do not have any illness, disease or impairment that may limit or endanger me while participating in the Activities. I accept and acknowledge that there is a risk of serious injury including permanent disability, paralysis, and death when undertaking such Activities which may be caused by my own actions or inactions, those of others participating in the Activities, the conditions in which the event takes place, or the negligence of the Company and the ‘releasees’ named below; and that there may be other risks not known to me or the Company, or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, costs, and damages I incur as a result of my participation in the Activities.
  4. I acknowledge and accept that I am responsible for my own safety (and the safety of my own possessions) while undertaking the Activities. I agree and assent to undertaking the Activities without a guide.
  5. I hereby release, discharge, and covenant not to sue the Company, its respective affiliates, administrators, directors, agents, officers, volunteers, members, employees, other participants, and sponsors, advertisers, and, if applicable, lessors of premises on which the Activities take place, (each considered one of the “releasees” herein) from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the releasees or otherwise, including negligent rescue operations; and I further agree that if, despite this release, waiver or liability, and assumption of risk, I, or anyone on my behalf, makes a claim against any of the releasees, I will indemnify, save, and hold harmless each of the releasees from any loss, liability, damage, or cost which may incur as the result of such claim.
  6. I acknowledge that by voluntarily participating in the Activities I am certifying that I have not been advised by any treating physician that I have a medical condition which any reasonable person would realize could be adversely affected by my participation in the Activities. I am certifying that any treating physician has not advised me to limit my physical activities and/or exercise in any way. I am also certifying to the best of my knowledge that I am not pregnant.
  7. I agree that this Release and Waiver of Liability, Assumption of Risk, and Agreement is intended to be as broad and inclusive as permitted by the laws of the state of Maine, and understand that included within the scope of this  Release and Waiver of Liability, Assumption of Risk, and Agreement is any cause of action ( including any cause of action based on negligence) arising from the performance, or failure to perform, maintenance, inspection, supervision or control of said Activities and premises and for the failure to warn of dangerous conditions existing at said premises, for negligent selection (or failure to view actions or inactions of participants) by certain releasees, or negligent supervision or instruction by releasees and that if any such portion of this Release and Waiver of Liability, Assumption of Risk, and Agreement is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. This Release and Waiver of Liability, Assumption of Risk, and Agreement shall be binding upon my heirs, personal representatives and assigns, and me. It shall be governed by and construed under the laws of the state of Maine without regard to conflicts of law principles.

I have read and voluntarily signed this Release and Waiver of Liability, Assumption of Risk, and Agreement and further agree that no oral representations, statement, or inducements apart from the foregoing written agreement have been made, and understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature.The Company may from time to time contact me (using a range of methods including electronic communications such as telephone, SMS or e-mail) about its product, services and special offers. I agree that you may keep my name and address on the Company database.

   I acknowledge I have read and understand this waiver and certify that all personal information is correct.*
